Let the games begin



The judicial review is set for April. However, how this works out is anyone's guess. We are still waiting on rulings on several open reviews, one none so glaring as the review on the G.O.N. Emmanuel case, a review that is in it's 5th year.


Judge Bernie Stephenson today approved the application for Judicial Review made by lawyers representing Roseau South MP Joshua Francis. This ruling by the judge prevents charges from being read to Mr. Francis in the ongoing Pay-to-Play sex scandal in Dominica.

Mr. Francis was arrested last week and charged with one count of indecent assault. He first appeared in court on Monday March 7th and ordered to reappear today for a determination on the judicial review application. The case now goes into a perpetual cycle for an indeterminable period of time. Lawyers usually take this route in an attempt to delay justice from being served, the hope being that the charges will be dropped, or witnesses move away or die. Are lawyers for Mr. Francis hoping that witnesses in this case leave the country and, over time, prove unwilling or cannot be located to provide testimony if or when the case is called? That remains to be seen, but one thing is for certain; justice delayed is justice denied.

Another thing that is certain; with the passage of time, more details will emerge. It is always best to deal with these things head on; time does not always prove to be a friend.
